Construction Period Costs definition

Construction Period Costs means the following costs incurred for the Building and the Property during the Construction Period that are the responsibility of Tenant elsewhere under this Lease (including the Work Letter): costs arising from (A) utilities and insurance, (B) any amount owed to Landlord pursuant to any indemnification obligation on the part of Tenant in favor of Landlord (with the parties agreeing that, during the Construction Period, Tenant’s indemnification obligation shall be limited as set forth in Paragraph 8.2(b)(ii) above), to the extent such indemnification obligation constitutes part of Landlord’s Project Costs, or (C) any and all other costs payable to Landlord or otherwise payable by Tenant under this Lease, including payments arising from a default by Tenant, to the extent such costs (including payments arising from a default by Tenant) constitute part of Landlord’s Project Costs. Examples of Construction Period Costs in a sentence

  • For purposes of computing the limits described in this subparagraph 4(C)(2)(c), Reimbursable Construction Period Costs “other than for Work” will include Third Party Contract/Termination Fees that qualify as Reimbursable Construction Period Costs pursuant to subparagraph 4(A)(6).

  • NAI has determined that the Construction Allowance to be provided to it under the Construction Agreement will not be sufficient to cover all Reimbursable Construction Period Costs yet to be paid or reimbursed from Construction Advances for the reason or reasons set forth in the Notice of NAI’s Intent to Terminate dated , 200___, previously delivered to you as provided in subparagraph 7(B) of the Construction Agreement.

  • Notwithstanding the foregoing, nothing in this Paragraph 5 (including limitations upon LRC’s rights to receive insurance or condemnation proceeds) is intended to limit or impair LRC’s rights, on and subject to the terms and conditions set forth in Paragraph 4, to receive Construction Advances as reimbursement for Reimbursable Construction Period Costs.

  • The Borrower shall apply the proceeds of the Loans and Equity Contributions wholly and exclusively to pay Construction Period Costs and the Development Costs, strictly in accordance with the Construction Period Budget and the Finance Documents.

  • LRC has determined that the Construction Allowance to be provided to it under the Construction Agreement will not be sufficient to cover all Reimbursable Construction Period Costs yet to be paid or reimbursed from Construction Advances for the reason or reasons set forth in the Notice of LRC’s Intent to Terminate dated , 200___, previously delivered to you as provided in subparagraph 7(B) of the Construction Agreement.

  • Landlord shall provide Akamai with a written notice (“Landlord's Expended Costs Notice”), not less frequently than quarterly, of the amount 145 Landlord has thus far expended on Included Construction Period Costs, as defined in Section 5.15.E below.
