Contaminated Lands definition

Contaminated Lands means lands, including surface water and groundwater, that contain any Contaminant to a level requiring remediation at law having regard for PRFN’s intended use of those lands should they be selected by PRFN pursuant to 6.1 or 6.2;
Contaminated Lands means lands, including surface water and groundwater, that contain any Contaminant to a level requiring remediation at law having regard for DRFN’s intended use of those lands should they be selected by DRFN pursuant to 6.2;
Contaminated Lands means any of the City Land in, under or over which Contaminants have been stored, kept, maintained, used, leaked, exposed, released, poured, emitted or otherwise discharged or migrated to;

Examples of Contaminated Lands in a sentence

  • Nothing in this Agreement precludes PRFN from recovering the costs incurred in the inspection or remediation of any Contaminated Lands transferred to PRFN, from any party, other than British Columbia or BC Hydro, who may be determined to be a responsible person under the Environmental Management Act or other relevant statutes or regulations in respect of the contamination of that site.

  • PRFN may elect, in its sole discretion, to accept Contaminated Lands identified under 9.3 and, if PRFN so elects and advises British Columbia in writing, British Columbia will transfer such lands to PRFN’s Designated Entity in accordance with and subject to all the terms and conditions of this Agreement.

  • The Parties acknowledge their mutual intention to not transfer Contaminated Lands to PRFN unless PRFN has made an informed decision.

  • Subject to 9.4, British Columbia will not transfer any lands pursuant to this Agreement, and PRFN will not accept any lands pursuant to this Agreement, that British Columbia or PRFN, as the case may be, knows are Contaminated Lands through the research process under 6.3 or 9.2.

  • DRFN may elect, in its sole discretion, to accept Contaminated Lands identified under 9.3 and, if DRFN so elects and advises British Columbia in writing, British Columbia will transfer such lands to DRFN’s Designated Company in accordance with and subject to all the terms and conditions of this Agreement.

  • The Parties acknowledge their mutual intention to not transfer Contaminated Lands to DRFN unless DRFN has made an informed decision.

  • Subject to 9.4, British Columbia will not transfer any lands to DRFN, and DRFN will not accept any lands for transfer from British Columbia, that British Columbia or DRFN, as the case may be, knows is Contaminated Lands through the research process under 6.5, 6.6 or 9.2.

  • WDNR continues to implement continuing obligations through its unique on-line Contaminated Lands Environmental Action Network (CLEAN) system.

  • DNR continues to implement continuing obligations through its unique online Contaminated Lands Environmental Action Network (CLEAN) system.
