Cosmetic Deficiencies definition

Cosmetic Deficiencies. In the Counties’ reasonable judgment after consultation with Contractor and in accordance with the Counties’ standard procedures for determining there is a Deficiency, a cosmetic or inconsequential Deficiency, although an accumulation, combination, or pattern of Cosmetic Deficiencies shall in the Counties’ reasonable judgment result in characterizing those Cosmetic Deficiencies as Deficiencies.
Cosmetic Deficiencies. Deficiencies that are cosmetic or inconsequential.

Examples of Cosmetic Deficiencies in a sentence

  • Contractor represents and warrants that each Deliverable, including without limitation, each of the Systems, shall conform to and perform in accordance with its applicable Specifications as provided herein, with the exception of Cosmetic Deficiencies as permitted in Section 9.2 of the Agreement.

  • The Counties will provide Acceptance for a Deliverable if it has no Deficiencies (except Cosmetic Deficiencies).

  • Corrects the Deliverable’s Cosmetic Deficiencies and Acceptance of Deliverables Pursuant to Change Requests.

  • Contractor shall correct Deficiencies and resubmit a corrected Deliverable to the Counties which will review or perform Acceptance Tests on the Deliverable to verify whether the Deliverable lacks Deficiencies except for Cosmetic Deficiencies) and with the Project Management Tool, in an email or in a written Notice or other document shall either give its Acceptance or reject it following such review or Acceptance Tests.

  • However, if a Deficiency (except for Cosmetic Deficiencies) is found, the Counties will notify Contractor with the Project Management Tool, in an email or in a written Notice or other document of Deficiencies used as the grounds for the Counties’ decision not to give Acceptance.

  • Cosmetic Deficiencies caused by Home Owner damage are not covered by this Warranty.

  • Contractor shall correct Deficiencies and resubmit a corrected Deliverable to AOC which will review or perform Acceptance Tests on the Deliverable to verify whether the Deliverable lacks Deficiencies (except for Cosmetic Deficiencies) and in writing shall either give its Acceptance or reject it following such review or Acceptance Tests.

  • Cosmetic Deficiencies include but are not limited to the following:  Hardwood and Laminate Flooring: scratches Drywall: dents, dings, marks, etc. Cabinets: warping, chipping, scratching, etc. Counter tops: chips, scratches, cracks, etc. Doors: dents, marks, holes, etc. Fixtures and appliances: dents, dings, scratches, etc. Paint: flashing, blistering, chipping, etc. Tile: cracks, scratches, chips, etc. Trim: blemishes, cracks, checking, etc. Windows and mirrors: cracks, scratches, etc.

  • AOC will pay Contractor the Holdback following receipt by AOC of an invoice which is issued in accordance with the terms of this Contract following correction by Contractor of Cosmetic Deficiencies and all other Deficiencies that were permitted by AOC on Acceptance of each Release.

  • This indicates that the respondents see their personal situation as more important than the overall choice context.All the previously mentioned findings are based on the measured and estimated choice behaviour of the respondents within the sample.

  • Cosmetic means surgery, procedures or treatment and other services performed primarily to enhance or improve appearance, including but not limited to, and except as otherwise required by state or federal law, those surgeries, procedures, treatments and other services performed in the absence of a functional impairment of a body part or organ as documented in the medical record, even if such services will improve emotional, psychological or mental condition or function.

  • Significant deficiency means a shortcoming in the system that materially affects the ability of officials of the Department of Defense to rely upon information produced by the system that is needed for management purposes.

  • Deficiencies means defects arising from non-conformity with the mutually agreed specifications and/or failure or non-conformity in the Scope of the Services.

  • Cosmetic Surgery means any Surgery, service, Drug or supply designed to improve the appearance of an individual by alteration of a physical characteristic which is within the broad range of normal but which may be considered unpleasing or unsightly, except when necessitated by an Injury.

  • Public health emergency means an emergency with respect to COVID–19 declared by a Federal, State, or local authority.

  • Visual impairment including blindness means an impairment in vision that, even with correction, adversely affects a student's educational performance. The term includes both partial sight and blindness.

  • Explosives or munitions emergency response means all immediate response activities by an explosives and munitions emergency response specialist to control, mitigate, or eliminate the actual or potential threat encountered during an explosives or munitions emergency. An explosives or munitions emergency response may include in-place render-safe procedures, treatment or destruction of the explosives or munitions and/or transporting those items to another location to be rendered safe, treated, or destroyed. Any reasonable delay in the completion of an explosives or munitions emergency response caused by a necessary, unforeseen, or uncontrollable circumstance will not terminate the explosives or munitions emergency. Explosives and munitions emergency responses can occur on either public or private lands and are not limited to responses at RCRA facilities.

  • Respiratory protective equipment means an apparatus, such as a respirator, used to reduce an individual's intake of airborne radioactive materials.

  • Statutory Penalties are those amounts awarded as a penalty, but are fixed in amount by statute.

  • Substitute Improvements means the substitute or additional improvements of the Issuer described in Article V hereof.

  • Emergency procurement means an acquisition resulting from an emergency need.

Notwithstanding the foregoing, Lessee may, without Lessor's prior consent, but upon notice to Lessor and in compliance with all Applicable Requirements, use any ordinary and customary materials reasonably required to be used by Lessee in the normal course of the Permitted Use, so long as such use is not a Reportable Use and does not expose the Premises or neighboring properties to any meaningful risk of contamination or damage or expose Lessor to any liability therefor. In addition, Lessor may (but without any obligation to do so) condition its consent to any Reportable Use of any Hazardous Substance by Lessee upon Lessee's giving Lessor such additional assurances as Lessor, in its reasonable discretion, deems necessary to protect itself, the public, the Premises and the environment against damage, contamination or injury and/or liability therefor, including but not limited to the installation (and, at Lessor's option, removal on or before Lease expiration or earlier termination) of reasonably necessary protective modifications to the Premises (such as concrete encasements) and/or the deposit of an additional Security Deposit under Paragraph 5 hereof.

  • Prohibited Waste means prohibited waste as defined in Schedule “D” to this Bylaw.

  • Cosmetology means the art or practice of embellishment, cleansing, beautification, and styling of hair, wigs, postiches, face, body, or nails.

  • Environmental Regulations means any federal, state or local law, statute, code, ordinance, regulation, requirement or rule relating to dangerous, toxic or hazardous pollutants, Hazardous Substances or chemical waste, materials or substances.

  • Restricted use pesticide means any pesticide or device which, when used as directed or in accordance with a widespread and commonly recognized practice, the director determines, subsequent to a hearing, requires additional restrictions for that use to prevent unreasonable adverse effects on the environment including people, lands, beneficial insects, animals, crops, and wildlife, other than pests.

  • Operating Deficit means that, at the end of the fiscal year, the unassigned fund balance in the General Fund is less than zero.

  • cosmetic product means any substance or mixture intended to be placed in contact with the external parts of the human body (epi­ dermis, hair system, nails, lips and external genital organs) or with the teeth and the mucous membranes of the oral cavity with a view exclusively or mainly to cleaning them, perfuming them, changing their appearance, protecting them, keeping them in good condition or correcting body odours;

  • Other health impairment means having limited strength, vitality, or alertness, including a heightened alertness to environmental stimuli, that results in limited alertness with respect to the educational environment, that:

  • Reportable Modified Mortgage Loan Any Mortgage Loan that (i) has been subject to an interest rate reduction, (ii) has been subject to a term extension or (iii) has had amounts owing on such Mortgage Loan capitalized by adding such amount to the Stated Principal Balance of such Mortgage Loan; provided, however, that a Mortgage Loan modified in accordance with clause (i) above for a temporary period shall not be a Reportable Modified Mortgage Loan if such Mortgage Loan has not been delinquent in payments of principal and interest for six months since the date of such modification if that interest rate reduction is not made permanent thereafter.
