Court’s Decision. The Supreme Court denied the petition, affirming the Court of Appeals’ decision. The petitioner’s claim to a 6% share in the real properties was based solely on his own testimony and that of Xxxxxxxxx Xxxxxxxxxx, which were not sufficient to prove the allegations. The documents presented by respondents adequately showed their personal capacity to acquire and fund properties independent of the partnership’s resources. The Court emphasized that an Acknowledgement of Participating Capital does not prove that the real properties were acquired out of the partnership’s proceeds, especially when the document specified certain businesses not including the properties in question. Doctrine: -Acknowledgements of Participating Capital specify the extent of ownership/share in a partnership and do not extend to properties or businesses not included within the scope of the document unless proven otherwise. -The sharing of gross returns does not of itself establish a partnership without showing an intent to form such an alliance, contribute money, property, or industry to a common fund, and divide the profits among the parties. -Certificates of title serve as the best proof of ownership and cannot be collaterally attacked in a proceeding. -Testimonial evidence cannot prevail over written evidence, especially during attempts to establish co-ownership based partially on oral evidence.   • Court means the Supreme Court of British Columbia;

  • Party or “Parties” has the meaning set forth in the Preamble.

  • Action shall have the meaning ascribed to such term in Section 3.1(j).

  • Grievance means a dispute arising out of the interpretation, application, administration or alleged violation of the terms of this Agreement.

  • Claim means any claim, action, cause of action, demand, lawsuit, arbitration, inquiry, audit, notice of violation, proceeding, litigation, citation, summons, subpoena, or investigation of any nature, whether civil, criminal, administrative, regulatory or other, and whether at law, in equity or otherwise brought against an Indemnified Person.

  • Authority means any governmental, regulatory or administrative body, agency or authority, any court or judicial authority, any arbitrator, or any public, private or industry regulatory authority, whether international, national, Federal, state, or local.

  • Parties has the meaning set forth in the Preamble.

  • Force Majeure means an event beyond the control of the supplier and not involving the supplier’s fault or negligence and not foreseeable. Such events may include, but is not restricted to, acts of the purchaser in its sovereign capacity, wars or revolutions, fires, floods, epidemics, quarantine restrictions and freight embargoes.

  • Force Majeure Event means an event, or a series of related events, that is outside the reasonable control of the party affected (including failures of the internet or any public telecommunications network, hacker attacks, denial of service attacks, virus or other malicious software attacks or infections, power failures, industrial disputes affecting any third party, changes to the law, disasters, explosions, fires, floods, riots, terrorist attacks and wars);

  • Notice means notice in writing;

  • Fraudulent practice means a misrepresentation of facts in order to influence a procurement process or the execution of a contract to the detriment of the Procuring Entity, and includes collusive practices among Bidders (prior to or after bid submission) designed to establish bid prices at artificial, non-competitive levels and to deprive the Procuring Entity of the benefits of free and open competition.

  • Targeted Advertising means presenting an advertisement to a student where the selection of the advertisement is based on Student Data or inferred over time from the usage of the operator's Internet web site, online service or mobile application by such student or the retention of such student's online activities or requests over time for the purpose of targeting subsequent advertisements. "Targeted advertising" does not include any advertising to a student on an Internet web site based on the content of the web page or in response to a student's response or request for information or feedback.

  • coercive practice means harming or threatening to harm, directly or indirectly, persons or their property to influence their participation in the procurement process or affect the execution of a contract;

  • Applicant shall have the meaning given to such term in Section 5.10.

  • Award means, individually or collectively, a grant under the Plan of Options, Stock Appreciation Rights, Restricted Stock, Restricted Stock Units, Performance Units or Performance Shares.

  • SEC means the Securities and Exchange Commission.

  • Confidential Information has the meaning set forth in Section 6.1.

  • Bidder means the legal entity which submits a Bid for consideration by City in accordance with the Invitation For Bid.

  • Minister means the Minister in the Government of the State for the time being responsible for the administration of the Act to ratify this Agreement and pending the passing of that Act means the Minister for the time being designated in a notice from the State to the Company and includes the successors in office of the Minister;

  • Application an application, in such form as the Issuing Lender may specify from time to time, requesting the Issuing Lender to open a Letter of Credit.

  • Working Day means a day (other than a Saturday or Sunday) on which banks are open for business in the City of London.

  • Applicable Law means all applicable provisions of constitutions, laws, statutes, ordinances, rules, treaties, regulations, permits, licenses, approvals, interpretations and orders of courts or Governmental Authorities and all orders and decrees of all courts and arbitrators.

  • Intellectual Property Rights shall have the meaning ascribed to such term in Section 3.1(p).

  • Event of Default has the meaning specified in Section 8.01.

  • Governmental Authority means the government of the United States or any other nation, or of any political subdivision thereof, whether state or local, and any agency, authority, instrumentality, regulatory body, court, central bank or other entity exercising executive, legislative, judicial, taxing, regulatory or administrative powers or functions of or pertaining to government (including any supra-national bodies such as the European Union or the European Central Bank).

  • Trustee means any person, including the founder of a trust, to whom property is bequeathed in order for such property to be administered for the benefit of another person.
