Damaged Products definition

Damaged Products means Products which are damaged during shipment to Customers which prevent them from being used for their intended purpose; and

Some manufacturers and publishers require DOAs to be handled directly with the manufacturer and in those cases ▇▇▇▇▇▇▇▇▇▇▇▇▇▇▇▇▇▇▇▇▇▇.▇▇▇'s Client Services will provide the contact information. All DOA returns must be 100% complete, contain ALL original boxes and packing material, have original UPC codes on the manufacturers packaging, contain all blank warranty cards, accessories and documentation provided by the manufacturer. Incomplete DOA returns will be subject to a minimum 50% restocking fee. Damaged Products means any Licensed Products (a) whose packaging or contents are damaged or adulterated by fire, water, spoilage or otherwise; (b) which are out of date or beyond its shelf-life; (c) which deviate from the final production samples approved by Masterfoods USA hereunder; or (d) which Licensee or Masterfoods USA reasonably believes in a condition inappropriate for sale or distribution to consumers.

  • If TrueLook elects to replace Damaged Products, the Customer shall be required to pay the full, retail price for a new Product of similar nature.

  • Customer shall make all Damaged Products that are the subject to a Rejection Notice available at all reasonable times for inspection at the Delivery Location by Supplier’s authorized representatives and shall provide all assistance to such authorized representatives as may reasonably be requested in conducting such inspection.

  • For returns of Products (other than returns of Defective Products, Unmerchandisable Products, Damaged Products, or Products erroneously shipped to Customers), Seller will pay Distributor a processing fee of $0.65 per unit for all units returned.

  • Damaged Products will be segregated from undamaged Products and disposed of at the direction of Customer.

  • Title to any replaced Damaged Products shall revert to Supplier upon Supplier’s pick up of such replaced Damaged Products.

  • In the event of the return by Customers of Defective Products, Unmerchandisable Products, Products shipped erroneously to Customers, and/or Damaged Products, the credit set out in this paragraph will include the freight costs initially charged to Seller by Distributor for those Products.
