Data Breaches definition

Data Breaches. Party shall report to AHS, though its Chief Information Officer (CIO), any impermissible use or disclosure that compromises the security, confidentiality or privacy of any form of protected personal information identified above within 24 hours of the discovery of the breach. Party shall in addition comply with any other data breach notification requirements required under federal or state law.

Data Breaches means the data breaches alleged in the First Amended Consolidated Class Action Complaint (“FAC”) in the MDL Case, In re: Yahoo! Inc. Customer Data Breach Security Litigation, Case No. 16-md-02752-LHK (N.D. Cal.), and in the CCAC in the JCCP Case, Yahoo! Inc. Private Information Disclosure Cases, JCCP No. 4895 (Orange County Superior Court).

Examples of Data Breaches in a sentence

• After consulting with the Controller, the Processor shall take any measures needed to limit the (possible) adverse effects of Personal Data Breaches (unless such consultation cannot be awaited due to the nature of the Personal Data Breach).

• The Processor shall document (and shall keep such documentation available for the Controller) any Personal Data Breaches, including the facts related to the Personal Data Breach, its effects and the corrective measures taken.

• Processor will reasonably assist Controller, at Controller’s expense, in ensuring compliance with Controller's obligations related to the security of the processing, notification and communication of Data Breaches, conduct of data protection impact assessments and any inquiry, investigation or other request by a supervisory authority.

• B & H Stone acknowledges its obligation in relation to the handling, use, disclosure and processing of Personal Information pursuant to the Privacy Act 1988 (“the Act”) including the Part IIIC of the Act being Privacy Amendment (Notifiable Data Breaches) Act 2017 (NDB) and any statutory requirements, where relevant in a European Economic Area (“EEA”), under the EU Data Privacy Laws (including the General Data Protection Regulation “GDPR”) (collectively, “EU Data Privacy Laws”).

User Security Liabilities shall not in any event include any Actions or Liabilities to the extent otherwise covered under Sections 1.4(a) through (g) above (provided that the Liabilities covered under Section 1.4(e)(x) shall not include (and User Security Liabilities shall include) any Liabilities to indemnify, defend or hold harmless any Third Party (for the avoidance of doubt, which term does not include any current or former directors or officers of, or persons in a comparable role with, Seller or the Business Subsidiaries) that would otherwise constitute User Security Liabilities hereunder). For the avoidance of doubt and notwithstanding anything herein to the contrary, it is the intention of the Parties that, as contemplated by Sections 7.2 and 7.3, the Company will be responsible for 50% of any User Security Liabilities other than Pre-Closing User Security Liabilities (as defined below), but that Seller will be responsible for (x) 100% of any Actions or Liabilities

Data Breaches means a breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or access to, personal data transmitted, stored or otherwise processed.
