Date of Demand definition

Date of Demand means with respect to each individual Set of Asset(s) and is the date of issuance of Letter of Demand by the Liquidator to the Successful Bidder of the respective Set of Asset(s) in accordance with the terms of this Memorandum. In case of Category A assets, in relation to acquisition of the Company as a whole on a going concern basis either in Asset Set 1 or Asset Set 2; in case of Category C Assets, in relation to acquisition of the respective Set of Asset(s) under Category C and in case of Category D Assets, in relation to acquisition of the respective Set of Asset(s) under Category D;
Date of Demand means the date (being a Business Day) on which the Transporter makes a Demand on a Counterparty’s Security Cover;
Date of Demand means the date (being a Business Day) on which Uisce Éireann makes a Demand on a Counterparty’s Security Cover;

  • Upon receipt of written notice from the Trustee in respect of the demand repayment, the Corporation shall have three Business Days to elect to repay the Note surrendered pursuant to this section or to satisfy such demand by issuing to the surrendering Noteholder such number of Common Shares as would be issued to such Noteholder if the Noteholder had elected to convert the Note into Common Shares pursuant to Article Three, as of the Date of Demand.
