Any novation will be contingent on the new entity meeting all eligibility requirements under the grant program and must be executed by a Deed of Novation between the Parties.
Only the parties and their relevant details can be changed by way of a Deed of Novation and no updates to the requirements or terms of the Grant Agreement will be made.
The selected Tenderer will be required to execute a Deed of Novation and Substitution, in the appropriate form, to ensure the rights of DFAT, in the event of DFAT issuing a note of substitution, at the time of executing the contract.
