Deemed Receipt shall have the meaning set forth in Section 3.3.
Deemed Receipt. Any communication from any party to the other under this Trust Deed shall be effective, (if by telex) when a confirmed answerback is received at the end of the transmission, (if by fax) when good receipt is confirmed by the recipient following enquiry by the sender and (if in writing) when delivered, except that a communication received outside normal business hours shall be deemed to be received on the next business day in the city in which the recipient is located.

Deemed Receipt. Any notice given under this agreement will be deemed to have been received: in the case of personal delivery, when delivered; in the case of posting, 2 Working Days following the date of posting; and in the case of email, when actually received in readable form by the recipient, provided that a delivery failure notice has not been received by the sender, in which case the notice will be deemed not to have been sent. Deemed receipt after 5pm or on a day that is not a Working Day: Any notice given in accordance with clause 28.2 that is personally delivered or sent by facsimile or email after 5pm on a Working Day or on any day that is not a Working Day will be deemed to have been received on the next Working Day. ELECTRICITY INFORMATION EXCHANGE PROTOCOLS Protocols for exchanging information: From time to time the Electricity Authority will publish certain EIEPs, including new or amended EIEPs, which specify recommended formats for the exchange of information between distributors and retailers. Unless this agreement or the Code require the parties to comply with one or more EIEPs when exchanging information, the Distributor and Retailer agree that they will use reasonable endeavours to comply with any relevant EIEPs when exchanging information, provided that the frequency at which, and method by which, the parties will exchange information is such that compliance with the EIEP is cost-effective for both parties.
Deemed Receipt. Any notice given under this Agreement will be deemed to have been received: (a) if delivered by hand, at the time of delivery; (b) if sent by post, on the third business day after the date of mailing; and (c) if delivered by email, on the business day the email is sent, provided that the email was correctly addressed to the address provided by the addressee for the receipt of email and no error message was received by the information system used by the sender to send such email. If any notice given under this Agreement is not given on a business day, or is given after 5:00pm on the day concerned in the place in which it is given, the notice will be deemed not to have been given until 9:00am on the next business day.
Deemed Receipt. Any communication from any party to any other under this Agreement shall be effective, (if by fax) when the relevant delivery receipt is received by the sender, (if in writing) when delivered and (if by electronic communication) when the relevant receipt of such communication being read is given or, where no read receipt is requested by the sender, at the time of sending, provided that no delivery failure notification is received by the sender within 24 hours of sending such communication; provided that any communication which is received (or deemed to take effect in accordance with the foregoing) after 5:00pm on a business day or on a non-business day in the place of receipt shall be deemed to take effect at the opening of business on the next following business day in such place. Any communication delivered to any party under this Agreement which is to be sent by fax or electronic communication will be written legal evidence.

  • Net Swap Receipt With respect to any Distribution Date, any net payment (other than a Swap Termination Payment) made by the Swap Provider to the Trust on the related Floating Rate Payer Payment Date (as defined in the Interest Rate Swap Agreement).
