Deficient Energy definition

Deficient Energy has the meaning as specified in Section 8.1.

Examples of Deficient Energy in a sentence

  • At the end of each Term Year commencing with the end of the second Term Year, if the sum of Qualified Amounts plus any Lost Output (calculated in accordance with Exhibit L) in the applicable Calculation Period does not equal or exceed Seller’s Energy Delivery Obligation, then an Event of Deficient Energy Deliveries will be deemed to have occurred.

  • At the end of each Term Year if the sum of the Qualified Amounts plus any Lost Output (calculated in accordance with Exhibit M) during the Term Year does not equal or exceed Seller’s Annual Energy Delivery Obligation, then an Event of Deficient Energy Deliveries will be deemed to have occurred.

  • If the kWh of energy actually delivered to the Delivery Point by Seller to TVA under this Agreement (“Actual Supply”) is not sufficient to meet the Annual Supply Guarantee for the Delivery Period in question (such shortfall being referred to herein as “Deficient Energy”), Seller shall pay liquidated damages to TVA with respect to the supply guarantee: (i) with respect to Deficient Energy, and (ii) with respect to RECs associated with the amount of the Deficient Energy, if applicable.

  • Notwithstanding any of the foregoing regarding the calculation of LDs for Deficient Energy, if Seller fails to deliver all or part of the Supply Guarantee as referenced above within any particular Delivery Period and if a RES has been enacted and is in effect with regard to that Delivery Period, Seller shall transfer to TVA, at no cost to TVA, the corresponding amount of RECs, regardless of whether Seller owes a LD payment to TVA under the provisions above in this Exhibit C.

  • Notwithstanding any of the foregoing regarding the calculation of LDs for Deficient Energy, if Seller fails to deliver all or part of the Supply Guarantee as referenced above within any particular Delivery Period, Seller shall transfer to TVA, at no cost to TVA, the corresponding amount of RECs, regardless of whether Seller owes a LD payment to TVA under the provisions above in this Exhibit C.

  • At the end of each Term Year if the sum of Seller’s Metered Amounts plus any Lost Output during the Term Year does not equal or exceed Seller’s Annual Energy Delivery Obligation, then an “Event of Deficient Energy Deliveries” shall be deemed to have occurred.

  • At the end of each Term Year commencing with the end of the second Term Year, if the sum of Qualified Amounts plus any Lost Output (calculated in accordance with Exhibit M) in the applicable Calculation Period does not equal or exceed Seller’s Energy Delivery Obligation, then an Event of Deficient Energy Deliveries will be deemed to have occurred.

  • At the end of each Term Year commencing with the end of the second Term Year, if the sum of Seller’s Metered Amounts plus any Lost Output in the twenty (24) month period immediately preceding the end of the applicable Term Year does not equal or exceed Seller’s Energy Delivery Obligation, then an “Event of Deficient Energy Deliveries” shall be deemed to have occurred.
