Section 2.1 Subject to all other provisions of this Agreement, Gatherer will, as nearly as practicable each Day, deliver for Producer’s account at the Points of Delivery a quantity of Gas thermally equivalent to the daily quantities of Delivered Gas.
Deviationsn is calculated for each calendar day as follows: If DDQn > 0, then Deviationsn = (Gas Index*DDQn) If DDQn < 0, then Deviationsn = (Delivered Gas Cost*DDQn) where: Delivered Gas Cost = The daily cost of natural gas, expressed in $/MMBtu, equal to the sum of the Gas Index and the Transport Cost for the applicable calendar day.

That certain Delivered Gas Purchase Contract, dated February 23, 1977, wherein originally Cascade Gas Co. is "Seller" and The Montana Power Company is "Buyer" and Northland Royalty Operating Company is now "Seller" and Great Falls Gas Company is now "Buyer", together will all prior amendments, as well as all future renewals, modifications, amendments, substitutions or replacements thereof pertaining to the lands described above and those referenced in said contract.
Section 5.4 Producer represents and warrants that it will, throughout the term of this Agreement, use its commercial efforts to secure adequate transportation capacity or make appropriate arrangements to market the Delivered Gas downstream of the Points of Delivery in sufficient quantities to allow Gatherer to receive and deliver all Gas produced by Producer from the Dedicated Area.
The term "Delivered Gas" shall mean the volumes of Gas (in Mcf) transported each Month on Transporter's System.
The "INTEREST RATE" in relation to each Eligible Currency specified below will be: Eligible Currency Interest Rate EUR For the relevant determination date, "EONIA", which means the overnight rate as calculated by the European Central Bank for such day, as set forth on Telerate Page 247 or any successor page.
The Delivered Gas Price per dt shall be determined each month in accordance with the provisions of Exhibit "A" attached to this Service Agreement.
Except for Gas supplied under Clause 8, the charge for Delivered Gas sold -------- and supplied by the Seller to the Buyer pursuant to this Agreement up to the MDQ is the Gas Price multiplied by the relevant quantity of Delivered Gas (in GJs).
All measurements, calculations and procedures used in determining volume, except for the correction for deviation from ▇▇▇▇▇'▇ Law, must be made in accordance with the instructions Measurement of Delivered Gas contained in the Gas Measurement Committee Report Number 3 of the American Gas Association, dated April 1955, together with all presently existing supplements, amendments and appendices to that Report.
