Disproportionate Advance definition

Disproportionate Advance is defined in Section 2.5(e).
Disproportionate Advance shall have the meaning in subsection 2(a) hereof.
Disproportionate Advance means any Advance made by a Lender wherein the amount advanced is not in accordance with such Lender’s Pro Rata share.

Examples of Disproportionate Advance in a sentence

  • Each Disproportionate Advance must be subject to a Eurodollar Pricing Option in accordance with the terms hereof with a Eurodollar Interest Period commencing no earlier than the date the Disproportionate Advance is created.

  • In the event Eurodollar Pricing Options are for any reason not generally available to the Lenders, the interest on such Disproportionate Advance shall be computed based on the Base Rate.

  • In the event the issuance of such Letter of Credit would cause the Credit Exposure owned by Paribas and Paribas Bank of Canada to exceed Paribas' Commitment, the U.S. Borrower and the Lenders shall create a Disproportionate Advance under Section 2.1.5. The Letter of Credit Issuer will send to each Lender (and the Agent if the Letter of Credit Issuer is not the Agent) a confirmation regarding the participations in Letters of Credit outstanding during such month.

  • On a daily basis (each, a “Settlement Date”), Agent shall provide each Lender with a statement of the outstanding balance of the Liabilities as of the end of the Business Day immediately preceding the Settlement Date (the “Pre-Settlement Determination Date”) and the current balance of the Loans funded by each Lender (whether made directly by such Lender to Borrowers or constituting a settlement by such Lender of a previous Disproportionate Advance made by Agent on behalf of such Lender to Borrowers).

  • In the event the advance of any extension of credit constituting a portion of the Canadian Loan would cause the Credit Exposure owned by Paribas and Paribas Bank of Canada to exceed Paribas' Commitment, the U.S. Borrower and the Lenders shall create a Disproportionate Advance under Section 2.1.5.
