All Code and Subcode Officials and Inspectors shall be duly licensed by the New Jersey Department of Community Affairs, Division of Codes and Standards.
In the event the Agreement is not terminated within the seven (7) day rescission period, Seller may withdraw the deposit monies from escrow as Seller has posted with the Escrow Agent a down payment bond guaranteeing the return of the released deposit monies in a form acceptable to the Division of Codes and Standards of the Department of Community Affairs, in the event that the Buyer becomes so entitled under the terms of this Agreement.
The Seller and the Escrow Agent have entered into a formal agreement acceptable to the Division of Codes and Standards that allows the Escrow Agent to release the Buyer's deposit monies from escrow to the Seller prior to Closing of title but not to exceed, in the aggregate, the face amount of the bond.
After the expiration of the seven (7) day rescission period as set forth above and in paragraph 7, the Deposit Money may be released to Seller provided Seller has placed a bond or other guarantee acceptable to the Division of Codes and Standards, Bureau of Homeowner Protection.
The Seller has obtained a “Bond to Secure Escrow Depositst” from QBE Insurance Corporation in a form acceptable to the Division of Codes and Standards of the New Jersey Department of Community Affairs so as to permit the Seller to obtain use prior to Closing of the Buyer’s deposit money being held by the Escrow Agent.
