The Owners, as grantors of the Easements, shall have the right to use the Parcels and Easement Areas for any purpose not inconsistent with the full use and enjoyment of the rights granted herein in favor of the other Owners as beneficiaries of the Easements.
No change from the conditions documented herein to the grade, topography, stormwater management structures or materials utilized within the Easement Areas shall be made without the prior written approval of the Village.
The City shall, at its sole cost and expense except as hereinafter described, construct a paved driveway and related improvements within the Easement Areas (Easement Areas M-1 and C-1).
If all, or a portion, of the Easement Areas is destroyed or damaged by fire or other casualty, the Parties shall promptly proceed to repair such damage and restore the Easement Areas to the condition existing prior to such damage.
