The omission of such a provision from any such written agreement shall not operate to impose personal liability on the Trustee, ECT, the ECT Trustees, the Administrator, any Unitholder or any Fund Annuitant.
The foregoing right of indemnification shall not be exclusive of any other rights to which ECT or the ECT Trustees may be entitled as a matter of law or equity.
All costs, charges and expenses reasonably incurred by ECT and the ECT Trustees in carrying out ECT’s obligations and duties hereunder in connection with the provision and performance of the Services (the “Expenses”) shall be payable by the Fund out of the Fund Property.
