The Charter School agrees to maintain and consistently implement a policy to identify students in need of ELL services, to provide services in an equitable manner to ensure meaningful access to the school’s educational program (including the provision of appropriate accommodations), and to facilitate obtaining English proficiency and exit from ELL services according to individual student capacity.
The needs of individual students, including students who qualify for ELL services, 504 services or IEP services, will be considered in addition to the number of students, in making elementary classroom assignments.
Subject to the terms of this Agreement, Licensee shall exert its best efforts to promote the sale of the ELL services contemplated by Section 3 of Exhibit A attached hereto pursuant to the rights granted in this Agreement and to develop and maintain a market demand for the same.

UP has autonomy over the structure and staffing of its Special Education and English Language Learner program models such that it meets federal and state guidelines regarding SPED and ELL services and teacher qualifications.
LCPS and the Charter School will cooperate and work together to ensure that staff assigned by LCPS to perform SPED and ELL services as needed at the school do so in manner that is high quality while being supportive of the Charter School’s curriculum and model to the extent possible.
