Section XVIII of the FFA requires that DOE submit an annual Site Management Plan (SMP), which outlines DOE’s strategic approach for achieving cleanup under the FFA, to EPA and the Energy and Environment Cabinet (formerly known as the Kentucky Environmental and Public Protection Cabinet) by November 15th of each year.

The Trustee shall make such payments from the Fund as the Director of the Division of Waste Management in the Kentucky Energy and Environment Cabinet, hereinafter the Director of the Division, shall direct, in writing, to provide for the payment of the costs of closure, corrective action, and/or postclosure care of the facilities covered by this Agreement.
