Environmentally Sensitive Area (ESA) definition

Environmentally Sensitive Area (ESA) means an area in which plant or animal life or their habitats are either rare or especially valuable because of their special nature or role in an ecosystem and which would be easily disturbed or degraded by human activities and developments (California Public Resources Code § 30107.5). Areas subject to storm water mitigation requirements are areas designated as Significant Ecological Areas by the County of Los Angeles (Los Angeles County Significant Areas Study, Los Angeles County Department of Regional Planning (1976) and amendments); an area designated as a Significant Natural Area by the California Department of Fish and Game's Significant Natural Areas Program, provided that area has been field verified by the Department of Fish and Game; an area listed in the Basin Plan as supporting the Rare, Threatened, or Endangered Species (RARE) beneficial use; and an area identified by the City as environmentally sensitive.
Environmentally Sensitive Area (ESA) means areas that include, but are not limited to, all Clean Water Act Section 303(d) impaired water bodies; areas designated as Areas of Special Biological Significance by the State Water Resources Control Board or the Regional Water Quality Control Board ; State Water Quality Protected Areas; water bodies designated with the RARE beneficial use by the State Water Resources Control Board; areas designated as preserves or their equivalent under the Natural Communities Conservation Program within Orange County; and any other equivalent environmentally sensitive areas which have been identified by the City.

Examples of Environmentally Sensitive Area (ESA) in a sentence

  • If archaeological properties within an undertaking’s APE are protected from any potential effects by establishment and effective enforcement of an Environmentally Sensitive Area (ESA), as described in Appendix 5 to this Agreement, the signatories agree that Caltrans may consider such properties to be NRHP eligible for the purposes of that undertaking.

  • If archaeological properties within an undertaking’s APE are protected from any potential effects by establishment and effective enforcement of an Environmentally Sensitive Area (ESA), as described in Attachment 5 to this Agreement, the signatories agree that Caltrans may consider such properties to be NRHP eligible for the purposes of that undertaking without conducting subsurface testing or surface collection.

  • If archaeological sites within a project or activity’s PAL are protected from any potential effects by establishment and effective enforcement of an Environmentally Sensitive Area (ESA), as described in Appendix 5 to this MOU, the signatories agree that Caltrans may consider such archaeological resources to be NRHP and/or CHL eligible for the purposes of that project or activity.

  • If archaeological resources within a project or activity’s PAL are protected from any potential effects by establishment and effective enforcement of an Environmentally Sensitive Area (ESA), as described in Appendix 5 to this MOU, the signatories agree that Caltrans may consider such archaeological resources to be NRHP and/or CHL eligible for the purposes of that project or activity.

  • Those locations included this segment of CC-80, which includes an Environmentally Sensitive Area (ESA).

  • If archaeological properties within an undertaking’s APE are protected from any potential effects by establishment and effective enforcement of an Environmentally Sensitive Area (ESA), as described in Attachment 5 to this Agreement, the signatories agree that Caltrans may consider such properties to be NRHP eligible for the purposes of that undertaking.

  • For bridge projects with Design Standards in Sensitive Watersheds (15A NCAC 04B .0124) commitment, all streams and unnamed tributaries shall have a 50-foot Environmentally Sensitive Area (ESA) on Clearing & Grubbing EC Plans only, and utilize 25-year peak rainfall data for surface area requirement for all sediment basins.

  • In the Vanderhoof District, wildlife habitat is managed as Environmentally Sensitive Area (ESA), proposed protected area, Crown land plans, Land and Resource Management Plans, Landscape Unit Plans, or the Forest Practices Code.

  • If eligible or assumed eligible archaeological resources are identified as a result of test excavations or during construction, avoidance will be the first priority with the establishment of an Environmentally Sensitive Area (ESA) designation that will protect the resource from any potential effects during construction.
