If Seller is unable to obtain such Estoppel Letter(s) 404 the same information shall be furnished by Seller to Buyer within that time period in the form of a Seller’s affidavit 405 and Buyer may thereafter contact tenant(s) or occupant(s) to confirm such information.
The Seller shall deliver to the Buyer as soon as practicable after Closing (i) an estoppel letter from each lessor pursuant to each of the Leases, substantially in the form attached hereto as Exhibit 2.6 (each individually, an "Estoppel Letter" and collectively, the "Estoppel Letters") and (ii) the written consent of 990 Xxxxxxx Xxxxxx Xxxx Associates, the lessor pursuant to Section 8 of the lease agreement set forth in Section 5.8 with respect to the sublease set forth therein.
If Seller is unable to obtain such Estoppel Letter(s) 416 the same information shall be furnished by Seller to Buyer within that time period in the form of a Seller’s affidavit 417 and Buyer may thereafter contact tenant(s) or occupant(s) to confirm such information.
If Estoppel Letter(s) or Seller’s affidavit, if any, differ materially from Seller’s representations and lease(s) provided pursuant to Paragraph 6, or if tenant(s)/occupant(s) fail or refuse to confirm Seller’s affidavit, Buyer may deliver written notice to Seller within 5 days after receipt of such information, but no later than 5 days prior to Closing Date, terminating this Contract and receive a refund of the Deposit, thereby releasing Buyer and Seller from all further obligations under this Contract.
If Seller is unable to obtain such Estoppel Letter(s) 402 the same information shall be furnished by Seller to Buyer within that time period in the form of a Seller’s affidavit 403 and Buyer may thereafter contact tenant(s) or occupant(s) to confirm such information.
