Excluded Circumstances definition

Excluded Circumstances your negligence, an accident, usage which exceeds our recommendations, use of equipment in a manner not authorized by this Agreement or any operator guide, use of equipment in an environment with unsuitable humidity and/or line voltage, damage in transit, virus contamination or loss of data, loss or fluctuation of power, fire, flood or other natural causes, external forces beyond our control, sabotage or service by anyone other than us, failure to use applicable software updates, use of equipment with any system for which we have advised you we will no longer provide support or which we have advised you is no longer compatible, or use of third party supplies (such as ink), hardware or software that results in (i) damage to equipment (including damage to printheads), (ii) poor indicia, text or image print quality, (iii) indicia readability failures or (iv) a failure to print indicia, text or images.
Excluded Circumstances means: (i) driver or other third party tampering with Products, accidental or intentional damage to the Products or any alteration or addition to the Products by anyone other than us; (ii) improper use of the Products or operator error; (iii) use of the Products with third party software or hardware other than that supplied by us; (iv) incorrect installation, maintenance or repair of our Products by anyone other than us or our Authorized Installers acting at our instigation;

Excluded Circumstances are circumstances outside of PBI’s control, including an accident, your negligent or reckless use of the equipment, use of the equipment which exceeds our recommendations or in a way not authorized by this Agreement or any operator guide, use of the equipment in an environment with unsuitable humidity, line voltage, damage in transit, software virus, loss of data, loss or fluctuation of power, fire, flood or other natural causes, and other external forces beyond our control. The warranty also does not apply if someone other than us services the equipment, you don’t use required software updates, you use the equipment with any system where we have told you that we will no longer provide support or that we have advised you is no longer compatible, or you use third party supplies (such as ink), hardware or software that results in (i) damage to equipment (including damage to printheads), (ii) poor indicia, text or image print quality, (iii) indicia readability failures or (iv) a failure to print indicia, text or images.
Excluded Circumstances means, with respect to a request for a Noteholder, Couponholder or beneficial owner to provide any forms, documentation or other information pursuant to Condition 10.2, that at the time of such request:
