Examples of Excluded Circumstances in a sentence
Excluded Circumstances are circumstances outside of PBI’s control, including an accident, your negligent or reckless use of the equipment, use of the equipment which exceeds our recommendations or in a way not authorized by this Agreement or any operator guide, use of the equipment in an environment with unsuitable humidity, line voltage, damage in transit, software virus, loss of data, loss or fluctuation of power, fire, flood or other natural causes, and other external forces beyond our control.
Not included as normal wear is coverage for repairs made necessary due to Excluded Circumstances.
If the Meter malfunctions or fails due to reasons other than Excluded Circumstances, then PBI will repair or replace the Meter.
For the avoidance of doubt, this remedy in clause 6.2 shall not apply to any Equipment that is not defective on delivery in the event that the defect(s) or non-performance is caused by any of the Excluded Circumstances.
