Notwithstanding the preceding, Contractor shall not be required to forfeit liquidated damages for an Excusable Delay or an Excusable and Compensable Delay pursuant to section 17 of Exhibit B.
A delay that entitles Contractor to an adjustment of the Contract Price and an adjustment to the Contract Time, and excuses Contractor from an assessment of Liquidated Damages for the specific delay period approved by the District for the Excusable and Compensable Delay.
