Existing Eligible CHP Facility means an Eligible CHP Facility that first commenced Operation on or after January 1, 2008 but before the Effective Date.

Existing Eligible CHP Facility means an Eligible CHP Facility that, during the entire Term, (1) satisfies the provisions of the Act as implemented by the CEC pursuant to Public Utilities Code Section 2843 in the CEC’s “Final Statement of Reasons” issued in June 2010, and (2) is a Qualifying Facility under PURPA, unless Seller is a public agency exempt from FERC jurisdiction under ▇▇ ▇▇▇▇▇▇ ▇▇▇▇▇▇ Code (“USC”) §824(f).
