Failure Points definition

Failure Points means points allocated to Project Co in respect of the occurrence of Availability Failures and Service Failures which are determined by the provisions set out in Part E of this Schedule 20.
Failure Points has the meaning given in the Project Agreement.
Failure Points has the meaning given in Schedule 20 – Payment Mechanism.

Examples of Failure Points in a sentence

  • Where, pursuant to Part 4 of Schedule 3 Service Failure Points have been allocated for the same trigger in three (3) consecutive months this shall be deemed to be a material breach which the Operator has been unable to remedy.

  • The number of Service Failure Points accumulated depends on the extent to which the Service Provider has failed to meet the Acceptable Service Level for each PI.

  • If the Performance Failure has not been rectified before the end of the Resolution Period, this shall result in the relevant number of Performance Failure Points as specified in column 8 of Table 1 to being allocated to the Contractor.

  • Y = the aggregate Service Failure Points accrued in a particular Month for all Performance Indicators, in accordance with this Schedule 5 (Service Level Agreement).

  • If the Contractor fails to Rectify the Performance Failure within the relevant Rectification Period set out in column 9 of Table 1 then a further set of relevant Performance Failure Points as set out in column 8 of Table 1 will be allocated to the Contractor.

  • Table 1 below provides the KPIs and the associated Performance Failure Points.

  • In the event of a Performance Failure in respect of any KPI as described in Table 1 the Contractor is entitled to the duration of the Resolution Period for the relevant KPI as specified in column 6 of Table 1 to rectify the Performance Failure before Performance Failure Points are allocated.

  • For each Performance Indicator there are three (3) bands of Service Failure Points.


More Definitions of Failure Points

Failure Points means points allocated to Project Co in respect of the occurrence of Availability Failures, Service Failures and Quality Failures which are determined by the provisions set out in Part G.
Failure Points means the points used in the calculation of the Failure Abatements in accordance with Section 6.7 of the Payment Schedule. Fair Market Value means the amount at which an asset could be exchanged in an arms length transaction between informed and willing parties, other than in a forced or liquidation sale. FICANZCA Guidelines means the guidelines published by the Faculty of Intensive Care, Australia and New Zealand College of Anaesthetists as updated from time to time. Final Refurbishment Works is defined in Clause 21.2(e)(ii). Financial Year means each 12 Month period commencing on 1 July and ending on 30 June. Fit For Purpose means that, in relation to any thing, it:

Related to Failure Points

  • Delivery Points means: (i) for natural gas transported by interstate pipelines, the city gate stations of your Utility, and (ii) for electricity, one or more points at which Company, as your agent, has arranged for the delivery of electricity to a third party (such as your Utility) for your account or at your premises.

  • Planned Outage means the removal of equipment from service availability for inspection and/or general overhaul of one or more major equipment groups. To qualify as a Planned Outage, the maintenance (a) must actually be conducted during the Planned Outage, and in Seller’s sole discretion must be of the type that is necessary to reliably maintain the Project, (b) cannot be reasonably conducted during Project operations, and (c) causes the generation level of the Project to be reduced by at least ten percent (10%) of the Contract Capacity.

  • Service Level Failure means a failure to perform the Software Support Services fully in compliance with the Support Service Level Requirements.

  • Excused Outage means any disruption to or unavailability of Services caused by or due to (i) Scheduled Maintenance,

  • Excused Downtime means the number of minutes in the Charging Period that the LSP is unavailable due to:

  • Receipt Point(s) means the receipt points set forth in Section 6 of this Toll Schedule.

  • MMcf means one million cubic feet.

  • Demarcation Point means the point where Qwest owned or controlled facilities cease, and CLEC, End User Customer, premises owner or landlord ownership or control of facilities begin. "Designed, Verified and Assigned Date" or "DVA" means the date on which implementation groups are to report that all documents and materials have been received and are complete.

  • Ground water means water below the land surface in a zone of saturation.

  • MSCF means one thousand standard cubic feet.

  • Throughput means the measure of production, or factor related to production, used to determine the relationship between the amount of energy used by the target unit and the levels of activity of the target unit, as set out in Schedule 6 to an underlying agreement; “the Tribunal” means the First-tier Tribunal established under the Xxxxxxxx Xxxxxx xxx Xxxxxxxxxxx Xxx 00000;

  • Connection Point means an exit point or an entry point or a bidirectional point identified or to be identified as such in an access contract.

  • Planned Downtime means planned downtime for upgrades and maintenance to the Services scheduled in advance of such upgrades and maintenance.

  • Core Hours means the period beginning at 8am and ending at 6.30pm on any day from Monday to Friday except Good Friday, Christmas Day or bank holidays;

  • Interconnection Point means the point(s) of connection(s) at which the project is connected to the grid i.e. it shall be at 11 / 22 kV bus bar level of substation of MSEDCL.

  • Delivery Point means the point(s) of connection(s) at which energy is delivered into the Grid System i.e. the Interconnection Point.

  • Process Gas means gas used for which alternate fuels, other than another gaseous fuel, are not technically feasible such as in applications requiring precise temperature controls and precise flame characteristics.

  • Cubic foot of gas means the amount of gas required to fill a cubic foot of space when the gas is at an absolute pressure of fourteen and seventy-three hundredths (14.73) pounds per square inch at a temperature of sixty (60) degrees Fahrenheit.

  • Critical Service Failure shall have the meaning given in paragraph 5.4 of the Order Form;

  • Listing Failure Event means that:

  • Downtime means the Total Minutes in the Month during which the Cloud Service (or Servers for Server Provisioning) does not respond to a request from SAP’s Point of Demarcation for the data center providing the Cloud Service (or Server for Server Provisioning), excluding Excluded Downtime.

  • CO2 means carbon dioxide.

  • Technical Failure means a failure of the court's hardware, software, and/or telecommunications facility which results in the impossibility of submitting a file electronically. Technical failure does not include malfunctioning of the equipment of the person submitting an e-file.

  • Subproject means a specific project to be carried out by an existing BE utilizing the proceeds of a Sub-loan or Investment, as hereinafter defined, fulfilling the conditions set forth in Part A of Schedule 4 to this Agreement;

  • Carbon dioxide equivalent or “CO2 equivalent” or “CO2e” means the number of metric tons of CO2 emissions with the same global warming potential as one metric ton of another greenhouse gas. Global warming potential values shall be determined consistent with the definition of Carbon Dioxide Equivalent in MRR section 95102(a).

  • Supply Failure shall have the meaning ascribed to it in Section 2.8.
