Filing a Petition definition

Filing a Petition means the submission of an adoption petition to the clerk of the court having jurisdiction and the clerk's acceptance and endorsement of the petition in the county where the petitioner resides.

  • Insolvency Filing means that a Share Issuer institutes, or has instituted against it by a court, regulator, supervisor, or any similar official with primary insolvency, rehabilitative, or regulatory jurisdiction over it in the jurisdiction of its incorporation or organization or the jurisdiction of its head or home office, or it consents to a proceeding seeking a judgment of insolvency or bankruptcy or any other relief under any bankruptcy or insolvency law or other similar law affecting creditors' rights, or a petition is presented for its winding-up or liquidation by it or such regulator, supervisor, or similar official or it consents to such a petition, provided that proceedings instituted or petitions presented by creditors and not consented to by the Share Issuer shall not be deemed an Insolvency Filing.

  • UCC Filing Collateral means any Collateral, including Collateral constituting investment property, for which a security interest can be perfected by filing a UCC-1 financing statement.

  • Filed with the secretary of state means, except as otherwise permitted by law or rule:

  • Prosecuting attorney means the prosecuting attorney for a county, an assistant prosecuting attorney for a county, the attorney general, the deputy attorney general, an assistant attorney general, a special prosecuting attorney, or, in connection with the prosecution of an ordinance violation, an attorney for the political subdivision that enacted the ordinance upon which the violation is based.

  • Filing Party has the meaning set forth in Section 6.12(b).

  • UCC Financing Statement A financing statement filed, or to be filed, pursuant to the UCC.

  • Filing Agent is defined in Section 5.1.13.

  • Financing Statement means a record or records composed of an initial financing statement and any filed record relating to the initial financing statement.

  • Bankruptcy Case has the meaning assigned to such term in Section 2.05(b).

  • Filing Date means, with respect to the Initial Registration Statement required hereunder, the 30th calendar day following the date hereof and, with respect to any additional Registration Statements which may be required pursuant to Section 2(c) or Section 3(c), the earliest practical date on which the Company is permitted by SEC Guidance to file such additional Registration Statement related to the Registrable Securities.
