Within 10 days after the Administrator disburses all funds in the Gross Settlement Amount, the Administrator will provide Class Counsel and Defense Counsel with a final report detailing its disbursements by employee identification number only of all payments made under this Agreement. 8. CLASS SIZE ESTIMATES and ESCALATOR CLAUSE. Based on its records, Defendants estimate that, as of the date of this Settlement Agreement, (1) there are 1,229 Class Members and 27,320 Total Workweeks during the Class Period. If the amount of workweeks for this time period is determined to be more than 10% higher than this estimate (i.e., 30,053 or more workweeks), the Net Settlement Amount shall be increased by the average payment to the Class Members based on the 27,320 workweeks amount. For example, if there are 20% more workweeks than the initial figure of 27,320 workweeks during the Class Period, then Defendants will increase the Net Settlement Amount by 20%.
