First Notice definition

First Notice has the meaning set forth in Section 4.3(a).

First Notice means notice to the Class in a form to be approved by the Court, which shall substantially be in accordance with the notice at Schedule “B”.

IF YOU FAIL TO EXPRESSLY GRANT OR DENY THIS REQUEST FOR APPROVAL IN WRITING WITHIN FIVE (5) BUSINESS DAYS AFTER YOUR RECEIPT, YOU WILL BE DEEMED TO HAVE APPROVED THIS REQUEST.” In the event that the Administrative Agent shall have failed to approve or disapprove such second request within five (5) Business Days after the Administrative Agent’s receipt of such second request, then such request shall be deemed to have been approved by the Administrative Agent.
First Notice means the short-form and long-form notices of certification of the Action, the opt out procedures and the pendency of the Approval Motion substantially in the forms attached as Schedules “B” and “C” hereto or as fixed by the Court.
