California Statutory Payments are subject to a pro rata decrease based on the amount remaining in the Settlement Fund following payment of the Fee Award and Expenses, Service Awards, Administration and Notice Costs, CAFA Notice costs, claims for reimbursement of documented Monetary Losses and costs of Financial Account Monitoring.
In the event that the aggregate amount of all Settlement payments exceeds the remaining funds available after payment of the costs of Settlement Administration, the costs of CAFA Notice, the costs of Financial Account Monitoring, the Fee Award and Expenses and Service Award(s), then each Settlement Class Member’s claim for the Alternative Pro Rata Cash Payment and the California Statutory Payment shall be proportionately reduced on a pro rata basis.
