free maintenance period refers to the free maintenance period (generally 12-months) after completion of “major modernisation works” or the installation of new “equipment” covered under or added to the Agreement.
34.3.1 Notwithstanding the requirements of Section-34.2, the maintenance charge in terms of Section-17 (charge) and penalties and/or credits in terms of Section-27 (penalties and credits) shall not apply to equipment maintained under the Agreement during the “free maintenance period”.
34.3.2 During the “free maintenance period”, it shall be accepted that the Contractor shall remain bound to the terms and conditions of the “modernisation works” or new installation works Form of Contract with regards to confidence trials and/or guarantees and/or penalties, and/or retention.
34.3.3 All special conditions pertaining to the “free maintenance period” as described under Section-34.3 shall become null and void on the date the “free maintenance period” is satisfactorily concluded in terms of the “modernisation works” or new project’s terms and conditions of contract or appointment, or on the date the Client become responsible for the maintenance charge in terms of Section-17 (charge).
