The Delivery Nomination must be equal to the Receipt Nomination, less Fuel and Loss.
Subject to the terms of this Agreement, Shipper dedicates and will deliver the Dedicated Production to the System and Gatherer will receive, accept, gather, and redeliver Dedicated Production at the Point(s) of Delivery less applicable Fuel and Loss.
The quantities of Dedicated Production redelivered at a Point(s) of Delivery will be Thermally Equivalent to the quantities of Dedicated Production received at a Point(s) of Receipt less Fuel and Loss.
Shipper will reimburse Gatherer for its share of the Fuel and Loss at the tailgate of the Fort ▇▇▇▇▇▇ Plant or as otherwise agreed to by the parties.
The difference between the quantity of gas removed and the quantity of gas redelivered shall be included in the calculation of the Measured Treating Fuel and Loss.
The quantities of Gas delivered pursuant to this Agreement at a Point of Delivery shall be Thermally Equivalent to the quantities of Gas received at a Point of Receipt, as adjusted for Fuel and Loss.
When the actual quantity of Gas received at a Receipt Point, less Fuel and Loss, is less than the confirmed Delivery Nomination, the excess quantity of Gas is hereinafter referred to as “Excess Deliveries”.
Producer shall reimburse Gatherer for the reasonable and Actual Costs of installing such additional equipment and the actual fuel and loss associated with the additional Treating shall be included in the calculation of the Measured Treating Fuel and Loss.
During the Term of this Agreement, DBM agrees to receive, gather, compress and deliver, less Fuel and Loss, AEP’s share of all Gas made available at the Point(s) of Receipt hereunder, subject to the nomination and confirmation procedures set forth in Section 3.2 hereof.
