  • Younique shall establish a Settlement Fund with a value of Three Million, Two Hundred and Fifty Thousand Dollars ($3,250,000.00) and shall make all cash payments due under this Agreement by paying this amount into a Qualified Settlement Fund at the Fund Institution, such fund to be established and administered by the Fund Institution as to meet the requirements applicable to a qualified settlement fund pursuant to Treasury Regulations Section 1.463B, subject to the following limitations and conditions.
