GNE Patents definition

GNE Patents means those claims within a Patent in which the invention(s) [***];

GNE Patents shall not include general patents covering manufacturing or process inventions, nor any patents arising from work performed not in relation to this Agreement.

GNE Patents means any and all Anti-CD40 Patents that are owned by GNE that are based upon inventions conceived or reduced to practice by GNE employees in the course of performing GNE's development obligations under this Agreement, including GNE's interest in any anti-CD40 Patents owned jointly by the Parties as provided hereunder. "GNE Patents" shall not include general patents covering manufacturing or process inventions, nor any patents arising from work performed not in relation to this Agreement.

Examples of GNE Patents in a sentence

In the event the Agreement is terminated by SG under this Section 3.3(c)(ii), or unilaterally by GNE under Section 9.2 prior to the filing by GNE of an IND on a Licensed Product, then, (A) upon request of SG, GNE shall grant a license to SG to all GNE Patents, GNE Know-how, Improvements and Regulatory Approvals or submissions; and (B) SG shall owe GNE royalties as set forth in Section 6.4 below.
For the purposes of this Article 7, SG Patent Rights and GNE Patents shall not include patents or applications owned jointly by the Parties.
SGI and GNE shall fully cooperate with each other in any action to enforce the GNE Patents.
Notwithstanding the license grants set forth in this Section F.1 or elsewhere in this Agreement, GNE retains a non-assignable (except as provided in Section 16.3) right under the GNE Patents and GNE Know-how solely for purposes of performing in vitro research and Development activities with respect to IGF-I in the Field.
All monies recovered upon the final judgment or settlement of any such suit to enforce any GNE Patents shall be retained by GNE.

By way of example only, and without limitation, GNE Patents shall not include U.S. Patent No. 4,816,567 or U.S. Patent No. 6,331,415, or any foreign counterparts thereof.

GNE Patents means any United States patent application, including any division, continuation, or continuation-in-part thereof and any foreign patent application or equivalent corresponding thereto and any Letters Patent or the equivalent thereof issuing thereon or reissue, re-examination or extension thereof, including GNE's interest in JOINT PATENTS which is owned by or licensed to GNE and in and to which GNE has a transferable interest during the term of this Agreement insofar as it contains one or more claims to GNE TECHNOLOGY. 1.21 The term "GNE TECHNOLOGY" shall mean information and materials, including but not limited to, inventions, whether patentable or not, pharmaceutical, chemical and biological products, technical and non-technical data and information relating to the results of tests, assays, methods, and processes, and drawings, plans, diagrams and specifications and/or other documents containing such information and data owned by GNE or to which GNE has a transferable interest on the EFFECTIVE DATE and/or prior to termination of this Agreement and which are necessary or useful for the manufacture, use or sale of a LICENSED PRODUCT in the FIELD. 1.22 The term "GROSS SALES" shall mean the gross amount invoiced by GNE or its AFFILIATES or permitted SUBLICENSEES for sales of a LICENSED PRODUCT to THIRD PARTIES in the OPTION TERRITORY. 1.23 The term "IBD" shall have the meaning set forth in Section 5.1.
