HOME CONTRACT FILE. With respect to each Land-and-Home --------------------------- Contract, (a) the original of the Land-and-Home Contract, and, in the case of each Bi-weekly Contract, the original of the bi-weekly rider for such Contract, and, in the case of each Escalating Principal Payment Contract, the original of the graduated payment rider for such Contract; (b) the original related Mortgage with evidence of recording thereon and any title document for the related Manufactured Home; (c) with respect to any Land-and-Home Contract not originated by Vanderbilt, the assignment of the Land-and-Home Contract from the originator to Vanderbilt with evidence of recording thereon; (d) with respect to any Land-and-Home Contract originated by Vanderbilt, an endorsement of such Land-and-Home Contract by Vanderbilt; (e) with respect to the Land-and-Home Contracts located in the ten states with the highest concentration of Land-and-Home Contracts, an Opinion of Counsel to the effect that Vanderbilt need not cause to be recorded any assignment which relates to Land-and-Home Contracts in such states to protect the Trustee's and the Certificateholders' interest in such Land-and-Home Contracts; provided, however, if Vanderbilt fails to ----------------- deliver such an Opinion of Counsel for any such states, with respect to the Land-and-Home Contracts located in those states, Vanderbilt shall provide an original executed assignment of the Mortgage, with evidence of recording thereon, showing the assignment from Vanderbilt to the Trustee or the separate trustee, as applicable; and (f) any extension, waiver or modification agreement(s) for each Land- and-Home Contract on the Schedule.
HOME CONTRACT FILE. With respect to each Land-and-Home --------------------------- Contract, (a) the original copy of the Land-and-Home Contract, and, in the case of each Bi-weekly Contract, the original of the bi-weekly rider for such Contract, and, in the case of each Escalating Principal Payment Contract, the original of the graduated payment rider for such Contract; (b) the original related Mortgage with evidence of recording thereon (or, if the original Mortgage has not been returned by the applicable office, a copy thereof, certified by such recording office, which will be replaced by the original Mortgage when it is so returned) and any title document for the related Manufactured Home;
HOME CONTRACT FILE. With respect to each Land-and-Home Contract,

  • Contract File means with respect to each Contract, the physical and/or electronic files in which Credit Acceptance maintains the fully executed original counterpart or “authoritative copy” (in each case, for UCC purposes) of the Contract (to the extent required in accordance with Section 3.03 of this Agreement), either a standard assurance in the form commonly used in the industry relating to the provision of a certificate of title or other evidence of lien, the original or electronic instruments modifying the terms and conditions of such Contract and the original or electronic endorsements or assignments of such Contract.

  • Asset File shall have the meaning assigned thereto in the Custodial Agreement.

  • Lease File means, for each Lease, the Collateral Lease File applicable to such Lease.

  • Receivable File means the documents (whether tangible or electronic) specified in Section 2.02 pertaining to a particular Receivable.

  • Custodial File Any mortgage loan document in the Mortgage File that is required to be delivered to the Trustee or Custodian pursuant to Section 2.01(b) of this Agreement.

  • Mortgage File The mortgage documents listed in Section 2.01 pertaining to a particular Mortgage Loan and any additional documents required to be added to the Mortgage File pursuant to this Agreement.

  • Servicing File The items pertaining to a particular Mortgage Loan including, but not limited to, the computer files, data disks, books, records, data tapes, notes, and all additional documents generated as a result of or utilized in originating and/or servicing each Mortgage Loan, which are held in trust for the Trustee by the Servicer.

  • Mortgage Loan File for inclusion in the Mortgage Loan File (to the extent such documents are in the possession of the Special Servicer) and copies of any additional related Mortgage Loan information, including correspondence with the Borrower Related Parties, and the Special Servicer shall promptly provide copies of all of the foregoing to the Servicer as well as copies of any analysis or internal review prepared by or for the benefit of the Special Servicer, provided that, such materials shall not include any Privileged Information.

  • Retained Mortgage File With respect to each Mortgage Loan, the file consisting of the Mortgage Loan Documents listed as items 6 through 12 of Exhibit C attached hereto. Securities Act: The Securities Act of 1933, as amended.

  • Loan File means, with respect to each Loan delivered to the Custodian, each of the Loan Documents identified on the related Loan Checklist.

  • Servicer File means, collectively, all documents, records and copies pertaining to a Mortgage Loan which are required to be included in the related Servicer File pursuant to Section 3 thereof.

  • Servicer Mortgage File All documents pertaining to a Mortgage Loan not required to be included in the Trustee Mortgage File and held by the Master Servicer or the related Servicer or any Sub-Servicer.

  • Case file means a record that is assembled and maintained for each application approved for state cost sharing.

  • Owner Mortgage Loan File A file maintained by the Custodian for each Mortgage Loan that contains the documents specified in Section 2.01(a) and any additional documents required to be added to the Owner Mortgage Loan File pursuant to this Agreement.

  • Servicer Mortgage Loan File As defined in each of the Servicing Agreements.

  • Servicing Records means all documents, books, records and other information (including, without limitation, computer programs, tapes, disks, data processing software and related property rights) prepared and maintained by the Servicer with respect to the Transferred Loans and the related Obligors.

  • Receivable Files means the documents specified in Section 3.3.

  • CMSA Special Servicer Loan File The data file in the "CMSA Special Servicer Loan File" format substantially in the form of and containing the information called for therein for the Mortgage Loans, or such other form for the presentation of such information as may be approved from time to time by the CMSA for commercial mortgage securities transactions generally and, insofar as it requires the presentation of information in addition to that called for by the form of the "CMSA Special Servicer Loan File" available as of the Closing Date on the CMSA website, is reasonably acceptable to the Special Servicer.

  • Trustee Mortgage File The mortgage documents listed in Section 2.01 hereof pertaining to a particular Mortgage Loan and any additional documents required to be added to the Trustee Mortgage File pursuant to this Agreement.

  • Collateral Records means books, records, ledger cards, files, correspondence, customer lists, blueprints, technical specifications, manuals, computer software, computer printouts, tapes, disks and related data processing software and similar items that at any time evidence or contain information relating to any of the Collateral or are otherwise necessary or helpful in the collection thereof or realization thereupon.

  • Master File has the meaning set forth in the CAISO Tariff.

  • CREFC® Special Servicer Property File format substantially in the form of and containing the information called for therein for the Mortgage Loans, or such other form for the presentation of such information as may be approved from time to time by the CREFC® for commercial mortgage securities transactions generally.

  • Collateral File With respect to each Mortgage Loan, a file containing each of the Collateral Documents.

  • Data File means a single record or collection of data records that are logically related to each other, and are handled as a unit;

  • Loan Files means the documents specified in Section 2.1 of the Sale Agreement.

  • CREFC® Special Servicer Loan File format substantially in the form of and containing the information called for therein for the Mortgage Loans, or such other form for the presentation of such information as may be approved from time to time by the CREFC® for commercial mortgage securities transactions generally.
