The public infrastructure referred to in clauses (1)-(8), above is part of the Horizontal Infrastructure for the respective Phases, and the construction thereof shall respectively start and shall be completed, subject to Force Majeure, according to the Project Construction Schedule for the respective Phases.

Such work constitutes part of the Horizontal Infrastructure Improvements.
Generally, the Infrastructure Improvements are described on Exhibit “H” which include the Horizontal Infrastructure Improvements and the Vertical Infrastructure Improvements.
Upon receipt of all Regulatory Approvals, including conceptual and final DDRB approvals, the Developer may elect to initiate the Horizontal Infrastructure Improvements, the Vertical Infrastructure Improvements, and/or one or more Developer Improvements by providing written notice to the City (the “Developer Notice to Proceed”).
Any parking surface removed by Developer in connection with environmental testing or remediation work shall be promptly restored after such work is complete by the Developer as a Direct Cost as part of the Horizontal Infrastructure Improvements.
Redesign Costs shall include, without limitation, all Soft Costs related to the Redesign Plan, including without limitation, costs associated with any subsequent environmental review that is required pursuant to CEQA, and Hard Costs related to the rebuilding, replacing, relocating or incremental cost of additional Horizontal Infrastructure as necessary to accommodate the Redesign Plan.
