Hybrid Products means the Financial Instruments and Transactions set out below.

Hybrid Products means products or materials of any kind, including flower, oils and extracts, that are comprised of or include any Hybrid Cultivar or plant material of any Hybrid Cultivar.

  • Each Party agrees not to enforce any infringement claim of the Intellectual Property Rights licensed under this Section 7.7 (a) based on a use of Hybrid products by a customer who purchases Hybrid Products from the licensee Party.

  • MSC agrees not to enforce any infringement claim of the Intellectual Property Rights licensed under this Section 7.5 (a) based on a use of MPM’s Materials and/or Hybrid Products by a customer who purchases MPM Materials and/or Hybrid Products from MPM.

  • MSC agrees not to enforce any infringement claim of the Intellectual Property Rights licensed under this Section 7.5(a) based on a use of MPM’s Materials and/or Hybrid Products by a customer who purchases MPM Materials and/or Hybrid Products from MPM.

  • For the avoidance of doubt, the royalty rates in this Section 14.3 apply to Hybrid Products save as set out in Section 14.4.

  • MPM agrees not to enforce any infringement claim of the Intellectual Property Rights licensed under this Section 7.5(a) based on a use of MSC’s Materials and/or Hybrid Products by a customer who purchases MSC Materials and/or Hybrid Products from MSC.

  • MPM agrees not to enforce any infringement claim of the Intellectual Property Rights licensed under this Section 7.5 (a) based on a use of MSC's Materials and/or Hybrid Products by a customer who purchases MSC Materials and/or Hybrid Products from MSC.

  • Notwithstanding anything to the contrary, this SECTION 7.9(D)(II) does not apply to E(P)40/50 Hybrid Products.
