Hydrocarbon Flaring or “HC Flaring” shall mean the combustion of refinery-generated gases, except for Acid Gas and/or Sour Water Stripper Gas and/or Tail Gas, in a Hydrocarbon Flaring Device. Nothing in this definition shall be construed to modify, limit, or affect EPA’s authority to regulate the flaring of gases that do not fall within the definitions contained in this Consent Decree.

The HC Flaring Devices currently in service at Calcasieu are identified in Appendix B to the Consent Decree. To the extent that, during the duration of the Consent Decree, Calcasieu utilizes HC Flaring Devices other than those specified in Appendix B for the purpose of combusting any excess of a
