IBM may assign this Agreement to any member of the IBM Group or at any time in connection with a sale or acquisition of IBM, whether by merger, consolidation, sale of all or substantially all of IBM’s assets, or similar transaction, without the consent of Kyndryl.
IBM Group includes IBM Corporation and any legal entity and the subsidiaries it owns by more than 50 percent.
