Furthermore, in case such payments not made on or before the due date specified herein, are required to be converted into Reais, for any reason whatsoever, then the same shall also be adjusted for inflation by the General Market Price Index variance supplied by the Fundacao ▇▇▇▇▇▇▇ ▇▇▇▇▇▇ (IGPM-FGV), or in case of its extinction, by a comparable index.

The non-payment of any amount due and payable hereunder within the period above mentioned shall subject the Purchaser to a compensatory penalty of ten percent (10%) over such unpaid amount, plus monetary adjustment based on the IGP-M/FGV, and a penalty interest of one percent (1%) per month, calculated on a pro rate temporis basis as of the maturity date until the effective full payment of the amount due.
In the event of the extinction of the IPCA and there is no legal substitute, the Monthly Value will be corrected by the variation of the IGPM/FGV.
If the term of the lease agreement should extend beyond 12 months, the rental payment for the subsequent periods shall be adjusted by the variation of the IGPM/FGV index.
If it becomes impossible or unfeasible to apply the IGPM-FGV, it will be replaced by the positive variation of the Broad Consumer Price Index calculated by the Brazilian Institute of Geography and Statistics (Índice Nacional de Preços ao Consumidor Amplo calculado pelo Instituto Brasileiro de Geografia e Estatística – IPCA/IBGE).
The fine shall be updated by the positive variation of the IGPM-FGV from the Closing Date until the date on which, if potentially due, it is paid.
