Indenture Funds definition

Indenture Funds means all funds held by the Bond Trustee, including funds swept from the Debt Service Reserve Fund described in the 2008 Bond Documents, in the Bond Trustee’s possession as of the Petition Date in the amount of $5,390,180.
Indenture Funds means any fund or account established pursuant to this Indenture.
Indenture Funds means any fund or account established pursuant to this Indenture. “Indenture Indebtedness” shall mean all indebtedness of the Issuer at the time securedby this Indenture, including without limitation (a) all Debt Service on the Bonds and (b) all reasonable fees, charges and disbursements of the Trustee for services performed and disbursements made under this Indenture.

Examples of Indenture Funds in a sentence

  • Money and investments from time to time on deposit in, or forming a part of, the Indenture Funds.

  • PROVIDED, HOWEVER, that money and investments in the Indenture Funds may be applied for the purposes and on the terms and conditions set forth in this Indenture.

  • After all Indenture Indebtedness has been Fully Paid, any money or investments remaining in the Indenture Funds or otherwise constituting part of the Trust Estate shall, subject to the requirements of Section 15.11, be paid to the Corporation if no Loan Default exists.

  • Concurrently with the execution of this Defeasance Agreement, there are herewith deposited with Trustee, from the Company Funds and the Indenture Funds, immediately available monies in the amount of $13,778,515.01; all of which amounts shall be deposited in the Defeasance Fund; and from such amount the amount of $13,778,158.76 shall be used to purchase the Government Securities described in Exhibit A attached hereto.

  • The rights and powers granted -------------------------------- to the Trustee by the Securities Intermediary have been granted in order to perfect its Lien and security interest in the Indenture Funds and the security entitle ments and financial assets carried therein or credited thereto, are powers coupled with an interest and will neither be affected by the bankruptcy of the Issuer nor the lapse of time.

  • The Funding Corporation acknowledges, confirms and agrees that it shall have no rights against or to monies held in the Indenture Funds, as third party beneficiary or otherwise.


More Definitions of Indenture Funds

  • Senior Subordinated Note Indenture the Indenture entered into by the Borrower and certain of its Subsidiaries in connection with the issuance of the Senior Subordinated Notes, together with all instruments and other agreements entered into by the Borrower or such Subsidiaries in connection therewith, as the same may be amended, supplemented or otherwise modified from time to time in accordance with Section 7.9.

  • Indenture Trust Estate means all money, instruments, rights and other property that are subject or intended to be subject to the lien and security interest of the Indenture for the benefit of the Noteholders (including all Collateral Granted to the Indenture Trustee), including all proceeds thereof.

  • Master Indenture means this Master Trust Indenture, as amended and supplemented from time to time in accordance with the provisions hereof.

  • Senior Subordinated Indenture means the Indenture, dated as of August 30, 2007, among the Company, the subsidiary guarantors party thereto from time to time and Xxxxx Fargo Bank, National Association, as trustee, governing the 13.5% Senior Subordinated Notes due 2015 of the Company, as the same may be amended, supplemented, waived or otherwise modified from time to time.

  • Property Trustee Account has the meaning set forth in Section 3.8(c).
