Independent Arbitrator definition

Independent Arbitrator means a nationally recognized global investment bank, independent accounting firm, or other advisor having relevant valuation expertise, in each case, agreed upon by the Holder and the Company.
Independent Arbitrator has the meaning set forth in Section 2.6(a).

Independent Arbitrator means a neutral and impartial arbitrator (i) who is listed on the American Arbitration Association's national roster of arbitrators, (ii) who has not had and does not have any past, current or potential business, professional, or personal relationship with any of the Parties involved in the arbitration proceedings which would interfere with the exercise of independent judgment in carrying out his or her responsibilities as an arbitrator, and (iii) whose conduct is guided by the Code of Ethics for Arbitrators in Commercial Disputes.
Independent Arbitrator means the independent arbitrator appointed pursuant to Article 3.1.6, for the resolution of disagreements as to the amount of Actual Consolidated Net Equity and the difference between the Actual Tax Credits and the Assumed Tax Credits;
