The Borrower and Guarantor/s confirms and agrees that the Lender shall also be entitled to disclose information, as stated above to any person as may be required/ specified by applicable laws including but not limited to consent for disclosure of information to Information Utilities set up pursuant to the Insolvency and Bankruptcy Code, 2016.
NeSL is an information utility (“IU”) registered with the Insolvency and Bankruptcy Board of India (hereinafter referred to as “IBBI”) having Registration No. IBBI/IU/01 and is governed by the provisions of Insolvency and Bankruptcy Code, 2016 (hereinafter referred to as “IBC”) and Insolvency and Bankruptcy Board of India (Information Utilities) Regulations, 2017 (hereinafter referred to as “IU Regulations”).
USFB shall have the right to disclose/submit the ‘financial information’ as defined under the Insolvency and Bankruptcy Code, 2016 (or any amendments thereto) and the Rules framed thereunder, in relation to the Loan transaction, to Information Utilities (“IU”) and the Borrower should promptly authenticate such ‘financial information’ submitted by USFB, as and when requested by the concerned IU.
Technical Standards shall mean the Guidelines for Technical Standards for the Performance of Core Services and Other Services under the Insolvency and Bankruptcy Board of India (Information Utilities) Regulations, 2017, as amended and modified from time to time.

NeSL shall store and maintain all the information received from Information Submitter in a secured data storage in the manner prescribed under IU Regulations, the Guidelines on Technical Standards for Core Services of Information Utilities and any other law for the time being in force or as may be modified from time to time.
