Interior Work, even if on the critical path, will not be considered for Excusable Delay unless adverse weather conditions prevented vehicular access to the Worksite to preclude such interior Work.
In no event shall Tenant be required to remove any structures or fixtures installed as part of the Initial Interior Work.
Landlord and Tenant shall each use its best efforts to collectively cause ▇▇▇▇▇ Corporation and Svigals Associates to coordinate the Interior Work with the Tenant's Work (as defined in Section 15 of this Third Amendment) with respect to the Additional Space in order not to delay completion of the Tenant's Work with respect to the Additional Space.
Landlord hereby agrees to complete the Interior Work in a good and workmanlike fashion, otherwise Tenant relies on no warranties or representations, express or implied, of Landlord or any agent or other party associated with Landlord as to its condition or repair, or as to taxes or any other matter relating to the Additional Space, except as otherwise expressly provided in the Lease, as modified by this Third Amendment.
Landlord shall cause the parties' architect (Svigals Associates) to clearly delineate Prep Work, to the extent required, and all of the Interior Work on all plans and drawings.
With respect to the warranty for the Base Interior Work, notwithstanding any provision in this Lease to the contrary, it is understood and agreed that the one year warranty shall apply only to those items of Base Interior Work listed on Exhibit C.
Landlord shall give Tenant prompt written notice following Landlord's receipt of funding from CHFA for the Prep Work and the Interior Work.
Appendix C – Interior Work Plans (defined in clause 6 (i) hereof).
Paric Corporation shall provide the warranties on the Base Interior Work and the Tenant Improvements for twelve (12) months following the Substantial Completion Date (defined below), and said improvements shall be constructed in good and workmanlike manner and in compliance with all Applicable Laws and building codes.
Landlord is responsible for restoring Landlord’s Base Interior Work and the Tenant Improvements (as defined in Sections 2.A and 2.B).
