The layoff of Sworn Management employees will be conducted in accordance with the City of Fontana’s Layoff Plan adopted by the City Council on May 7, 1991.
Subsequent to the execution of this CEA by all Parties, LSU will file a layoff plan (the "Layoff Plan") with the Louisiana Civil Service Commission that will provide for LSU’s Hospital employees ("LSU Personnel") to be laid off as LSU employees, subject to the approval of the Civil Service Commission, as of 11:59:59 p.m. on the day before the Commencement Date.

Layoff Plan In the interest of employees who may be adversely affected by a general layoff arising from the need to reduce the work force, the City may first solicit volunteers for alternative measures, such as early retirement, demotion, job sharing, reduced work hours and the like, in order to reduce the impact upon employees, so long as it is in the City's best interest to take such measures.
After receiving a copy of this waiver, the Employee agrees that he has had ample and reasonable opportunity to carefully review and consider this waiver of benefits under the Layoff Plan.
The Employee hereby knowingly and voluntarily waives any rights to participate in or continue to participate in the Layoff Plan, which is incorporated herein by reference.
Except as otherwise provided in Section B.2 of this Article, the Employer agrees, during the term of this Agreement, that its Long Service Layoff Plan benefits will continue to be made available to those qualifying employees covered by this Agreement to the same extent and in the same manner as were made available by the Employer immediately prior to the execution date of this Agreement.
