Legal position definition

Legal position means of proof required: 1. Presentation of a recent extract from the judicial record or, in the absence thereof, of a recent equivalent document issued by a legal or administrative authority in the country of origin or of provenance. When such a document or certificate is not issued by the country in question, it may be replaced by a sworn statement or, in the absence thereof, by a solemn statement on the part of the interested party before a legal or administrative authority, a notary public or a qualified professional body in the country of origin or of provenance. 2. Certificate issued by the competent authority of the State in question as sufficient proof that the candidate or tenderer has fulfilled obligations relating to the payment of social security contributions or the payment of taxes in accordance with the legal provisions of the country in which they are established or with those of the country of the EMCDDA or those of the country where the contract is to be performed. When such a document or certificate is not issued by the country in question, it may be replaced by a sworn statement or, in the absence thereof, by a solemn statement on the part of the interested party before a legal or administrative authority, a notary public or a qualified professional body in the country of origin or of provenance. 3. A sworn statement as sufficient proof that: a) they have not been guilty of grave professional misconduct; b) following another procurement procedure or grant award procedure financed by the Community budget, they have not been declared to be in serious breach of contract for failure to comply with their contractual obligations.
Legal position means of proof required: 1. Proof of entry on the register of companies issued by the appropriate body in the country where candidates are registered. 2. Recent certificate from the judicial record or, failing this, an equivalent document recently issued by a judicial or administrative body in the country of origin or whence they come. Where no such documents or certificates are issued in the country concerned, they may be replaced by a statement on oath or, failing that, a solemn declaration made by the interested parties before a judicial or administrative body, a notary or a qualified professional body in the country of origin or whence they come. 3. Certificate issued by the appropriate body in the country concerned, showing that they have fulfilled their obligations relating to the payment of social-security contributions and taxes, in accordance with legal provisions in their country of residence, in the country of the contracting authority or in the country in which the contract will be performed. Where no such documents or certificates are issued in the country concerned, they may be replaced by a statement on oath or, failing that, a solemn declaration made by the interested parties before a judicial or administrative body, a notary or a qualified professional body in the country of origin or whence they come. 4. Statement on oath attesting that: a) they have not been guilty of grave professional misconduct; b) following another procurement procedure or grant award procedure financed by the Community budget, they have not been declared to be in serious breach of contract for failure to comply with their contractual obligations. III.2.1.2) Economic and financial capacity — means of proof required: Statement as to turnover for the services referred to in the contract during, at most, the last 3 financial years.
