The License Model Schedule is incorporated into this EULA; «Аффилированное лицо» означает любую компанию, контролируемую, контролирующую или находящуюся под общем контролем с одной из Сторон настоящего Соглашения. В случае если юридическое лицо прекращает соответствовать приведенным выше требованиям, то, для целей настоящего Соглашения, оно прекращает являться Аффилированным лицом. «Требование» означает любую претензию, иск, производство или судебный процесс, предъявляемый или инициируемый третьим лицом в отношении Лицензиата в суде надлежащей юрисдикции на Территории действия лицензии в связи с предполагаемым нарушением патентных или авторских прав или коммерческой тайны в соответствии с законодательством Территории действия лицензии, о чём ОТ известно. «Территория действия лицензии» означает Австралию, Австрию, Бельгию, Канаду, Данию, Финляндию, Францию, Германию, Италию, Новую Зеландию, Норвегию, Испанию, Швецию, Швейцарию, Нидерланды, Соединённое Королевство Великобритании и Северной Ирландии и США. «Документация» означает руководство по эксплуатации, руководство пользователя и примечания к версии, действующие по состоянию на дату поставки соответветствующего Программного обеспечения и предоставляемые ОТ. «Лицензионная документация» означает настоящее Соглашение, включая все дополнительные соглашения, Приложение о типе лицензии, Документацию по сделке (в том числе, данные по ценообразованию), Документацию, «Уведомления для третьих лиц» (xxx.xxxxxxxx.xxx/xxxxxxxxxx) и другие документы, предоставляемые ОТ и регулирующие порядок использования Программного обеспечения. «Лицензионный сбор» означает невозмещаемый сбор, выплачиваемый Лицензиатом ОТ за предоставление Лицензий на Программное обеспечение. «Тип Лицензии» означает условия, положения и ограничения, применимые и регулирующие порядок использования Лицензии на Программное обеспечение. «Приложение о типе лицензии» применительно к каждой отдельной Лицензии на Программное обеспечение означает документ под названием «Приложение о типе лицензии», опубликованный по адресу: xxxx://xxx.xxxxxxxx.xxx/agreements, с изменениями и

  • The Project Plan means the document to be developed by the Supplier and approved by the Purchaser, pursuant to GCC Clause 19, based on the requirements of the Contract and the Preliminary Project Plan included in the Supplier’s bid. The “Agreed and Finalized Project Plan” is the version of the Project Plan approved by the Purchaser, in accordance with GCC Clause 19.2. Should the Project Plan conflict with the Contract in any way, the relevant provisions of the Contract, including any amendments, shall prevail.
