On or before the date which is thirty (30) days after the date hereof (or such longer period of time as Lender shall agree in its sole discretion), Borrowers shall cause that certain UCC-1 Financing Statement naming Lodging Enterprises, as debtor, and Sysco Kansas City, Inc., as secured party, filed with the Kansas Secretary of State as Filing Number 71364538 to be terminated of record or amended in a manner reasonably satisfactory to Lender.
As used in this Section 6.6, “Restricted Payments” will not include the distribution by Borrowers of those amounts remaining in escrow upon the closing of the Lodging Enterprises Transaction, or deposits made pursuant to the Unit Purchase Agreement.
