  • We note that actions assessed under LUPAA which are not declared projects of regional significance, nor characterised as Level 2 activities or treated as such under Environmental Management and Pollution Control Act 1994 (EMPCA) will not be declared actions for the purposes of the draft Agreement (they are also not covered by the current Agreement).
