If Customer desires Verint to install and configure any Updates, or Verint provides Services as a result of any conditions specified in Section 4.2 or 4.3, or otherwise provides support services to Customer outside the scope of services specified for Customer’s applicable Maintenance and Support Plan, Verint may charge Customer for such services at Verint’s then current Professional Service Fee rate.
TSP shall perform such maintenance and repair in accordance with the provisions of the approved Maintenance and Support Plan and in accordance with the approved Safety Plan, Quality Management Plan, Configuration and Change Management Plan, and Maintenance of Traffic Plan, and other requirements of the Contract Documents.
This support offering is called the Software Maintenance and Support Plan (“SMS Plan”).
The Contractor shall develop a Maintenance and Support Plan which details the organization and activities necessary to provide operational support for S-BSS throughout the Warranty period.

Verint’s obligations with respect to each End User shall be in accordance with the terms and conditions of the Maintenance and Support Plan applicable to the Support level applicable to that End User, and Reseller shall ensure the End User has agreed to those terms and conditions.
Deltagen shall perform such installation, maintenance and support in accordance with the Installation Maintenance and Support Plan attached as Exhibit C.
