Maintenance Easement Area definition

Maintenance Easement Area means the five foot (5’) strip of land located immediately adjacent to the Property and running along the east, west and north boundary lines of the Property, which Maintenance Easement Area is shown cross-hatched on Exhibit A-2 attached hereto. Grantee may exercise the aforesaid maintenance easement only to the extent reasonably necessary for the maintenance of the improvements now or hereafter constructed on the Property and only in such a manner so as not to unreasonably interfere with the use of the improvements now or hereafter constructed on ▇▇▇▇ ▇ ▇▇▇ ▇ (▇▇ ▇▇▇▇▇ ▇▇ ▇▇▇ ▇▇▇▇). Notwithstanding anything to the contrary set forth herein, in no event shall Grantor be required to move any structures to accommodate Grantee’s exercise of the maintenance easement, nor shall the maintenance easement granted herein limit or restrict Grantor from constructing, maintaining, repairing or operating improvements in the Maintenance Easement Area. Grantee shall be responsible for any damage to improvements on Grantor’s property or incurred by Grantor in connection with Grantee’s exercise of the maintenance easement.

Examples of Maintenance Easement Area in a sentence

  • The Grantor covenants that no digging, tunneling, or other form of construction activity shall be done on the Grantor’s Real Property, the Right-of-Way Easement Area, or the Maintenance Easement Area that would disturb, damage, unearth, or undermine any of the Facilities, or endanger the lateral support to any of the Facilities.
