Manufacturing Defect definition

Manufacturing Defect means, in respect of a Product, any manufacturing related non-conformance with the requirements set out in Section 2.04(b) and Section 2.04(e) upon Delivery;
Manufacturing Defect with respect to any Product shall mean the failure to meet the Specifications or readily apparent and visible handling or transit damage.
Manufacturing Defect means that the product deviated in its construction or quality from its specifications or planned output in a manner that renders it unreasonably dangerous. An “unreasonably dangerous” product is one that is dangerous to an extent beyond that which would be contemplated by the ordinary user of the product, with the ordinary knowledge common to the community as to the product’s characteristics.

Examples of Manufacturing Defect in a sentence

  • Warranty claims must be received within 30 calendar days after the Warranty Holder identifies the Manufacturing Defect or other basis for a warranty claim.

  • The limited warranty for Manufacturing Defects does not apply after the Warranty Holder has installed the Flooring, and product variation or error that does not exceed the 5% industry standard is not considered a Manufacturing Defect for purposes of this limited warranty.
