Market-based sourcing means the sourcing method used for gross receipts from transactions other than sales of tangible personal property under the single sales factor apportionment formula set forth in Rule 8 of this Regulation.
Market-based sourcing means the sourcing method used for gross receipts from transactions other than sales of tangible personal property under the single sales factor apportionment formula set forth at RIGL § 44-11-14(b). For tax years beginning on or after January 1, 2015, market-based sourcing is the method that all entities treated as C corporations for federal income tax purposes must use to determine how to treat a corporation’s sales of services and/or intangible personal property – whether or not they are part of a combined group.
Market-based sourcing means, for apportionment purposes for tax years beginning on or after January 1, 2015, the method that all taxpayers organized under subchapter C of the Internal Revenue Code must use to determine how to treat a corporation’s sales of services.41 Market-based sourcing generally means that receipts from transactions are sourced to the market state – that is, to the state where the recipient of the service receives benefit from the service. All gross receipts from the performance of services are included in the numerator of the apportionment factor if the recipient of the service receives all of the benefit of the service in Rhode Island. If the recipient of the service receives some of the benefit of the service in Rhode Island, the gross receipts are included in the numerator of the apportionment factor in proportion to the extent the recipient receives benefit of the service in Rhode Island.
